Authorization to Return to Canada

Have you ever been asked to leave Canada? If yes and you may require an Authorization to Return to Canada (ARC). Whether you require an ARC depends on the type of order of removal that you received.

Types Of Removal Order

There are three main types of removal order.
  • Deportation Order
  • Exclusion Order
  • Departure Order
The document you received when asked to leave Canada will contain a form number which entails the type of removal order.
If you were issued a Deportation Order (form number IMM 5238B), you will need to apply for an Authorization to Return to Canada (ARC). However, if you were deported due to criminal activity, you must apply for criminal rehabilitation and Temporary Resident Permit to gain entry to Canada again.
If you were issued a Departure Order (form number IMM 5238) and you left Canada within 30 days (about 4 and a half weeks) and your departure is confirmed by a Canadian immigration officer, then you are not required to apply for the ARC. However, if you left Canada without confirming your departure and more than the 30 days (about 4 and a half weeks) that you were required to leave, the exclusion order becomes a Deportation Order, and you will have to apply for an ARC.
If you were given an Exclusion Order (form number IMM 1214B) and a year had passed since you left Canada and you have a proof that shows the date of your departure from Canada, you may not need an ARC. You could return to Canada based on normal examination at the port of entry.

Documents Required To Apply For ARC

  • A copy of a valid passport
  • Two copies of passport sized photographs
  • A letter that describes the reasons you should be allowed to return to Canada.
  • A temporary resident visa application form.

How Long Does It Take To Process An Authorization To Return To Canada (ARC)

Previously, ARC applications were processed within six (6) weeks. However, given the current backlog and the high volume of applications that IRCC is dealing with, estimated processing times are no longer accurate, and you should expect a longer processing time.
